Mandatory payments by persons who have not served
The designated size of mandatory payments by persons who have not passed mandatory military service:
The Republic of Armenia Act of 17th of December 2003 “On the Citizens Who Have Not Passed Compulsory Military Service due to violation of the established order,” provides that citizens of the Republic of Armenia are under obligation to make mandatory payments for release from criminal prosecution and to receive their mandatory military record card, to account for citizens left in reserve, that have not passed mandatory military service in the period from autumn conscription in 1992 before the 1st of May 2015.
According to this law, citizens of the Republic of Armenia who have violated this law and were not present for conscription in that period can make payments in the following order:
- Men of military service age who are citizens of the Republic of Armenia, who have attained 27 (twenty-seven) years of age and who have not passed compulsory military service, shall pay the amount equal to one hundred times the current minimum wage in the Republic of Armenia;
- Men of military service age, who are citizens of the Republic of Armenia, who have not passed compulsory military service on grounds for exemption from military service:
- A reserve citizen who for health reasons was declared unfit for military service and was withdrawn from the accounts of The Republican Military Commission of the Republic of Armenia shall pay the sum of 30 (thirty) times the minimum wage in the Republic of Armenia;
- A reserve citizen who is an only child and/or whose parent, or other family members died in the defense of the Republic of Armenia, died in the armed forces, or during the performance of official duties in other forces, is exempt from compulsory payments regardless of whether he has attained the age of 27 (twenty-seven) years;
- Men of military service age, who are citizens of the Republic of Armenia who have a scientific degree of candidate or doctor of science and are engaged in professional, scientific, or educational activities shall pay the sum of 50 (fifty) times the minimum wage in the Republic of Armenia;
- Men of military service age, who are citizens of the Republic of Armenia, who have not passed compulsory military service and later received a deferment from military service to continue their studies, pay an amount of 50 (fifty) times the minimum wage in the Republic of Armenia;
- Men of military service age, who are citizens of the Republic of Armenia, who have not passed compulsory military service and later acquired grounds for postponement by marital status. The following persons belong to the category mentioned in this paragraph:
- The son, who is liable for military service who has disabled/incapacitated parents, either a father or a mother, if they have no other children undergoing compulsory military service and are able-bodied citizens of the Republic of Armenia.
- A reserve citizen growing up without a mother;
- A reserve citizen who has two or more children;
- A reserve citizen whose wife has a disability of first, or second degree;
- A reserve citizen living with the brother, or sister, who has a disability of first, or second degree, or declared incapable by a court decree, provided that no other able-bodied member of the family is living together with him, IE: he is the only care provider;
- A reserve citizen whose wife is expecting their second child, or twins and is in her sixth month of pregnancy;
- In the above and all other cases associated with marital status and not provided for by law, a reserve citizen pays an amount of 30 (thirty) times the minimum wage in the Republic of Armenia;
- A reserve citizen who has not passed the military service, and has three, or more children, or is a single parent of two children is exempt from compulsory payments regardless of whether he has attained the age of 27 (twenty-seven) years;
- Men of military service age, who are citizens of the Republic of Armenia, who have not passed military service and later were freed from service by the state of health, pay the amount of 30 (thirty) times the minimum wage in the Republic of Armenia.
Incapacity is defined as:
- Parents who have reached the retirement age;
- Parents who have disabilities of first, or second degree;
- Parents found incompetent by a court decree,
The procedure and the chronology of the submission and consideration of applications for exemption:
All statements and applications for exemption from mandatory military service presented by a citizen of the Republic of Armenia must be signed and contain the following information:
- The name and surname of the citizen;
- Their citizenship;
- The address of residence, or registration in the territory of the Republic of Armenia, or elsewhere;
- The reasons for exemption from mandatory military service;
- The asking period of exemption from mandatory military service.
The following documents must be attached to the application:
- Their passport, birth certificate and copies thereof;
- Their certificate of residence and place of registration;
- Their certificate of marital status;
- Their reasons for an exemption from mandatory military service.
The time required to consider the applications by citizens and to answer should not exceed two months. When the request is denied, the conscripts are sent a written response stating the grounds for denial. When the requests are granted, the conscripts are sent a written statement stating the bank account number for mandatory payments of penalties, where appropriate. The letter also includes the final date by which the payment must be received in full, as after this period, the payment will be declined. The official response by The Conscription to Military Service of a citizen of the Republic of Armenia can be appealed in court within one month from the date of its receipt.
The payment process:
The citizen of the Republic of Armenia who has not passed mandatory military service and who have received a satisfactory response to their application for exemption must make the appropriate payment to the bank account specified in the letter. The raised amounts are used to meet the military needs of the Republic of Armenia.
Termination of criminal prosecution and enrollment in the army reserve:
After the payment has been received, a decision on the termination of criminal prosecution by the relevant body is given within one month, as well as, the citizen’s personal mandatory military card. He is then enlisted in the reserves of the Republic of Armenia.
