Toughening of liability for the transfer of communication equipment to prisoners
The Ministry of Justice has submitted for consideration a new draft law providing for amendments to the Criminal Code of the Republic of Armenia and the Code of Administrative Offences of the Republic of Armenia. The aim of the project is to exclude the transmission or use of telecommunication means that are prohibited for persons held in custody or serving sentences in penitentiary institutions.
According to the draft law, it is proposed to introduce criminal liability for the transfer of telecommunication equipment to detained persons, persons who are in custody or serving a sentence in a penitentiary institution, in the form of imprisonment for up to 3 years. In the event of the commission of this offence by an employee of the administration of a penitentiary institution or a person who, due to his official position, had the opportunity to communicate with persons in custody, the liability will be imprisonment for up to 5 years.
