In what case is it possible to hold a second round of elections to the National Assembly?

The Electoral Code sets out in which case it is possible to hold a second round of elections to the National Assembly.

According to Article 98 of the Code

  1. The two parties (party blocs) for which the largest number of voters voted shall participate in the second round of elections, with the exception of the case established by part 3 of this Article.
  2. New blocs may be formed around the parties (party blocs) participating in the second round of elections, consisting of the parties (party blocs) that have overcome the barriers, if they have come to an agreement on the candidate for prime minister.

The application for the creation of a new bloc, signed by the leaders of all parties-members of the new bloc (all parties-members of the bloc of parties), is submitted to the Central Election Commission before 18.00 hours on the 5th day after the decision to hold the second round.

  1. If the two parties (party blocs) that received the largest number of “yes” ballots together constitute a new bloc, then the party (party bloc) that received the largest number of “yes” ballots and received the following ballots that are not part of the new bloc, for which a new bloc can also be formed, participates in the second round of elections., after the decision of the Central Election Commission to hold the second round of elections, it is submitted to the Central Election Commission before the 7th day, until 18.00, in accordance with the procedure established by the Central Election Commission.
  2. If a new bloc wins in the second round of elections, whose member parties (party blocs) jointly received 54 or more percent of the total number of mandates distributed in parts 4-9 of Article 95 of this Code (summing up the results of the elections to the National Assembly), then they retain the received mandates.
  3. If a new bloc wins the second round of elections, whose member parties (party blocs) jointly received more than 2/3 of the mandates distributed in Parts 4-9 of Article 95 of this Code, then the other parties (party blocs) receive additional mandates in accordance with the procedure established by Part 2 of Article 96 of this Code.
  4. The party (party bloc) that won the second round of elections or the new bloc that (the parties-members of which jointly) received less than 54 percent of the mandates distributed in parts 4-9 of Article 95 following the results of the first round, receives additional mandates in accordance with the procedure established by part 1 of Article 96 of this Code.
