{"id":7058,"date":"2020-09-22T18:18:31","date_gmt":"2020-09-22T14:18:31","guid":{"rendered":"http:\/\/www.armenianlaw.com\/?p=7058"},"modified":"2021-02-03T18:21:47","modified_gmt":"2021-02-03T14:21:47","slug":"human-organ-and-or-tissue-transplantation-in-the-republic-of-armenia","status":"publish","type":"post","link":"https:\/\/www.armenianlaw.com\/en\/human-organ-and-or-tissue-transplantation-in-the-republic-of-armenia\/","title":{"rendered":"Human organ and (or) tissue transplantation in the Republic of Armenia"},"content":{"rendered":"\n<p><strong>&#8220;My body is my property!&#8221; \u2013everyone is\nconvinced of this.<\/strong><\/p>\n\n\n\n<p>Since Soviet times, our mentality has been implanted\nwith the fact that the will of a person, even after his death, acts in relation\nto what belongs to him by nature.<\/p>\n\n\n\n<p>In other words, even after death, each of us has the\nright to dispose of his body.<\/p>\n\n\n\n<p>But is this\nreally the case in the twenty-first century within the legal framework?<\/p>\n\n\n\n<p>Today, representatives of all countries are serious\nabout the above issue, respectively, and strive to create a fairly serious\nlegal framework for human organ and tissue transplantation. However, the means\nand methods of legal regulation of this issue on the part of the state depend\non which of the two existing principles is observed by the country concerned.<\/p>\n\n\n\n<p>So, all over the world, modern transplantology\ndistinguishes two principles of organ and tissue removal: the presumption of\nconsent and the presumption of disagreement.<\/p>\n\n\n\n<p><strong>The presumption of consent<\/strong> States that the deceased is initially not against the\nremoval of his organs and tissues after his death, if he does not Express his\ndisagreement in any form.<\/p>\n\n\n\n<p>Thus, the Law of those countries where the principle\nof consent prevails allows for transplantation in the absence of the will of\nthe deceased to disagree.<\/p>\n\n\n\n<p>The will of the deceased person can be expressed both\nin writing and orally in the presence of witnesses.<\/p>\n\n\n\n<p>As a formula,\nthis principle looks like this:<\/p>\n\n\n\n<table class=\"wp-block-table\"><tbody><tr><\/tr><tr><td><\/td><\/tr><\/tbody><\/table>\n\n\n\n<p>As for the <strong>presumption\nof dissent<\/strong>, it implies that the deceased is inherently opposed to\ntransplantation. According to the Law of those countries where the principle in\nquestion prevails, the removal or transplantation of organs and (or) tissues of\nthe deceased is possible only if there is a written confirmation (statement) of\nthe donor&#8217;s consent to the transplantation in relation to their transplant\nobjects during their lifetime.<\/p>\n\n\n\n<p>According to the presumption of disagreement, the will\nof the deceased person must be stated exclusively in writing.<\/p>\n\n\n\n<p>As a formula,\nthis principle looks like this:<\/p>\n\n\n\n\n\n<p>It is important to note that both in the case of the\nfirst principle and the second, the will of a close relative of the deceased\nperson is equated with the will of the deceased himself.<\/p>\n\n\n\n<p>Now let&#8217;s focus\non the legislation Of the Republic of Armenia.<\/p>\n\n\n\n<p>Which of these\ntwo principles applies to our territory?<\/p>\n\n\n\n<p>On the issue of human organ and tissue\ntransplantation, the RA Law &#8220;on human organ and\/or tissue\ntransplantation&#8221; has been in force in the Republic of Armenia since April\n16, 2002.<\/p>\n\n\n\n<p>This RA Law establishes the legal basis for human\norgan transplantation, as well as the rights and obligations of the donor on\nthe territory of Armenia.<\/p>\n\n\n\n<p>From the General meaning of the Law, we can say that\nthe Republic of Armenia is based on the principle of &#8220;presumption of\ndisagreement&#8221;.<\/p>\n\n\n\n<p>According to Article 6 of the above Law,\ntransplantation is carried out with the written consent of the recipient. And\nArticle 7 establishes: &#8220;Organs and (or) tissues from a corpse for the\npurpose of transplantation may be removed only in cases where the person in\nquestion has given written consent to this during his lifetime.&#8221;<\/p>\n\n\n\n<p>A mandatory condition for carrying out a transplant in\nthe Republic of Armenia from a living donor or cadaver is the absence of other\nmedical means that would guarantee the preservation of life and (or)\nrestoration of the patient&#8217;s health (article 2 of the RA Law &#8220;on\ntransplantation of human organs and \/ or tissues&#8221;).<\/p>\n\n\n\n<p>Thus, the first step on the part of the Armenian state\nhas already been taken \u2013 a regulatory legal act has been adopted that provides\nArmenian citizens with the opportunity to undergo transplantation.<\/p>\n\n\n\n<p>However, the main problem of modern transplantology in\nArmenia is a significant lack of donor organs.<\/p>\n\n\n\n<p>Every year, dozens of citizens in Armenia require\nkidney transplants only, and, unfortunately, their number is steadily growing. As\na result, it is advisable to adopt a Law based on the principle of\n&#8220;presumption of consent&#8221;.<\/p>\n\n\n\n<p>In other words, in the Republic of Armenia, the\ninstitution of refusal, rather than permission, should operate for organ\ntransplantation of cadavers.<\/p>\n\n\n\n<p>On the basis of the refusal Institute, anyone who does\nnot want their organs and \/ or tissues to be used to save the lives of other\npeople after their death can write a statement of refusal, and the electronic\nregister of refusals will display information that there is no legal reason to\nuse this person&#8217;s organs.<\/p>\n\n\n\n<p>If a person does not Express their will in writing,\nArmenian medical workers will be able to use their organs and (or) tissues.<\/p>\n\n\n\n<p>At the same time, this innovation will effectively\nserve the interests of the Armenian people only if people are informed about\nit.<\/p>\n\n\n\n<p>Be informed in\norder to fully dispose of your property-your body!<\/p>\n\n\n\n<p>Generally speaking, this innovation is humane, because\nit makes it possible to save the lives of other people living on the territory\nof Armenia.<\/p>\n\n\n\n<p>In the end, if a\ntransplant from a deceased donor is not legally allowed in the future, then\nthere is no point in talking about saving people&#8217;s lives in this way at all.<\/p>\n\n\n\n<p>The next important problem that exists is the problem\nof our Armenian mentality, according to which Armenians are biased against the\nproposal to take the organ and (or) tissue from the deceased.<\/p>\n\n\n\n<p>It is necessary to make the Armenian society aware of\nthe importance of this issue, so that people agree to transplant their organs\nin the event of their death in order to prolong someone&#8217;s life. &nbsp;It is obvious that no Armenian citizen will\nobject to a free organ transplant if necessary.<\/p>\n\n\n\n<p><strong>It is high time to think: will we agree to become\ndonors in the event of death?<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&#8220;My body is my property!&#8221; \u2013everyone is convinced of this.
