One of the important points of this law is the requirement that any deprivation of property rights is declared only via the appropriate courts. In the event of nationalization, the law of the Republic of Armenia provides for full compensation.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Foreign investors in the Republic of Armenia are protected from harm caused by the unlawful actions of the government. The RA Law &#8220;On Foreign Investments&#8221; also provides for the right for the investor to freely export from the Republic of Armenia their cash and profits made during their investment. For example, after the implementation of investments in the law &#8220;On Foreign Investments&#8221; of the Republic of Armenia, the law is amended and this amendment is influencing their investment, the investor has the right for the duration of five years to get rid of any points that do not meet the objectives of their investment.<\/span><\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Types of foreign investments in the Republic of Armenia<\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Foreign investments in the Republic of Armenia may be implemented in the form of:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Foreign currency;<\/span><\/li>\n<li><span style=\"color: #000000;\">Movable and immovable property, or any associated property rights;<\/span><\/li>\n<li><span style=\"color: #000000;\">Any type of securities provided for by the legislation of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Cash requirements, legal requirements, and fulfillment of obligations if they have the contract price;<\/span><\/li>\n<li><span style=\"color: #000000;\">The intellectual property rights;<\/span><\/li>\n<li><span style=\"color: #000000;\">The realization of the right to economic activity not prohibited by the legislation of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Realization of the rights and the extraction of natural resources;<\/span><\/li>\n<li><span style=\"color: #000000;\">The paid services;<\/span><\/li>\n<li><span style=\"color: #000000;\">Other investments not prohibited by the legislation of the Republic of Armenia.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>\u00a0<\/strong><\/span><\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Forms of realization of foreign investments in the Republic of Armenia<\/strong><\/span><\/h4>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Foreign investors have the right to implement investment projects on the territory of the Republic of Armenia by;<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">The acquisition of existing enterprises;<\/span><\/li>\n<li><span style=\"color: #000000;\">Opening of branches, or representative offices of foreign legal entities;<\/span><\/li>\n<li><span style=\"color: #000000;\">Opening a foreign legal entity;<\/span><\/li>\n<li><span style=\"color: #000000;\">The acquisition of shares in existing <a href=\"https:\/\/www.armenianlaw.com\/en\/turnover-tax-as-an-alternative-to-vat-and-profit-tax-in-the-republic-of-armenia\/\">companies on the territory of Armenia<\/a>;<\/span><\/li>\n<li><span style=\"color: #000000;\">Through the creation of new legal entities with the participation of the citizens of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Through the acquisition of the securities provided by the legislation of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Independently, or via a legal entity in the Republic of Armenia, or with a person not having legal personality, as well as, with the participation of the citizens of the Republic of Armenia and the acquisition of rights to land use, and by acquisition of concessions for use of natural resources in the territory of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Acquisition of other property rights;<\/span><\/li>\n<li><span style=\"color: #000000;\">Conclusion of contracts with legal entities or other organizations not having legal status;<\/span><\/li>\n<li><span style=\"color: #000000;\">Other means not prohibited by the legislation of the Republic of Armenia.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The prohibition or restriction of types of realization of foreign investments may be allowed to proceed only in accordance with the legislation of the Republic of Armenia.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #000000;\">03.12.2015<\/span><\/strong><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Guarantees for foreign investments in the Republic of Armenia: The purpose of the RA Law &#8220;On Foreign Investments&#8221;, adopted on the 31st July of 1994 is to attract foreign investment and guarantee the non-nationalization of said investment.
