{"id":1007,"date":"2015-04-27T12:19:50","date_gmt":"2015-04-27T08:19:50","guid":{"rendered":"http:\/\/dev3.smartproductionllc.com\/?p=1007"},"modified":"2018-03-13T22:12:06","modified_gmt":"2018-03-13T18:12:06","slug":"legal-status-of-foreigners-in-armenia","status":"publish","type":"post","link":"https:\/\/www.armenianlaw.com\/en\/legal-status-of-foreigners-in-armenia\/","title":{"rendered":"Foreign citizenship in the Republic of Armenia"},"content":{"rendered":"<div class=\"modal-show-text\">\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">According to the RA law &#8220;On foreigners&#8221;, foreign nationals have the same rights, freedoms and obligations as the citizens of the Republic of Armenia on the territory of the Republic of Armenia, unless otherwise provided by the Constitution, laws and international treaties.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The Constitution of the Republic of Armenia states that a foreign citizen has the right to:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Has a right to own and\/or rent property on the territory of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Has a right to work;<\/span><\/li>\n<li><span style=\"color: #000000;\">Has a right to engage in business activities on the territory of the Republic of Armenia.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The Constitution of the Republic of Armenia states that a foreign citizen is obliged to:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Pay taxes;<\/span><\/li>\n<li><span style=\"color: #000000;\">Pay State duties;<\/span><\/li>\n<li><span style=\"color: #000000;\">Perform other mandatory payments specified by law;<\/span><\/li>\n<li><span style=\"color: #000000;\">Respect the RA Constitution, laws and other regulations.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>A foreign citizen has no right to:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">To enter the territory of the Republic of Armenia without a visa;<\/span><\/li>\n<li><span style=\"color: #000000;\">To be selected in the state bodies and local self-government of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">To participate in the referendum;<\/span><\/li>\n<li><span style=\"color: #000000;\">To work in the public services;<\/span><\/li>\n<li><span style=\"color: #000000;\">To create a party and be a member of the party;<\/span><\/li>\n<li><span style=\"color: #000000;\">To land ownership.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">When defending their rights, foreign citizen enjoys all rights set for the RA citizens&#8217; safeguards. A foreigner also retains the legal relationship and enjoys the diplomatic protection of the country where he\/she is a national. On the territory of the Republic of Armenia, foreigners have equal responsibility with the citizens of the Republic of Armenia, except for cases stipulated by international treaties of the RA.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Status of persons with foreign citizenship who are Armenian nationals in the Republic of Armenia:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Individuals of Armenian origin with foreign citizenship, have the following privileges:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">They may be granted the status of temporary, permanent and special residence;<\/span><\/li>\n<li><span style=\"color: #000000;\">They may receive citizenship of the Republic of Armenia via a simplified procedure. Foreign nationals who have received the status of a particular type of residence will get a passport with duration of ten years, which will allow them to enter the territory of the Republic of Armenia without a visa and to enjoy the right to own land in the Republic of Armenia.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>The order of stay and residence of foreign nationals on the territory of the Republic of Armenia:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">According to the RA law on \u2018the stay and residence of foreigners in the Republic of Armenia\u2019, there are three types of residence permit:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">The temporary permit where one gets issued with a temporary residence card;<\/span><\/li>\n<li><span style=\"color: #000000;\">The permanent permit where one gets issued with a permanent residence card;<\/span><\/li>\n<li><span style=\"color: #000000;\">The special residence status where one gets issued a special passport.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><a href=\"https:\/\/www.armenianlaw.com\/en\/on-the-acquisition-of-residence-status-in-the-republic-of-armenia\/\">Temporary residence permit<\/a> in the Republic of Armenia are granted to any foreigner if they prove the reason(s) of their residence in the territory of the Republic of Armenia within one year or longer:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">These reasons may be:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Training;<\/span><\/li>\n<li><span style=\"color: #000000;\">A work permit;<\/span><\/li>\n<li><span style=\"color: #000000;\">A marriage to a citizen of the Republic of Armenia, or when legally residing in the territory of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">A kinship with the Republic of Armenia citizen, or a foreigner with a permanent residence permit in the Republic of Armenia, such as a parent, brother, sister, spouse, son, grandmother, grandfather, grandson of the foreigner;<\/span><\/li>\n<li><span style=\"color: #000000;\">When they are involved with business activities;<\/span><\/li>\n<li><span style=\"color: #000000;\">Have Armenian nationality and\/or origin.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>A permanent residence permit in the Republic of Armenia is granted to a foreign citizen when:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Proved the existence of a close relative, such as a parent, spouse, brother, sister, children, grandmother, grandfather, a grandson who are residing in the territory of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Are provided with an apartment and means of subsistence in the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Have resided in the Republic of Armenia for at least three years prior to submitting an application for a permanent residence permit;<\/span><\/li>\n<li><span style=\"color: #000000;\">Are engaged in entrepreneurial activity on the territory of the Republic of Armenia;<\/span><\/li>\n<li><span style=\"color: #000000;\">Are Armenian by nationality and\/or origin.<\/span><\/li>\n<\/ul>\n<h4 style=\"text-align: justify;\"><strong><span style=\"color: #000000;\">04.27.2015<\/span><\/strong><\/h4>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>According to the RA law &#8220;On foreigners&#8221;, foreign nationals have the same rights, freedoms and obligations as the citizens of the Republic of Armenia on the territory of the Republic of Armenia, unless otherwise provided by the Constitution, laws and international treaties.
